Authorisation, one of the REACH processes for managing risks of substances of very high concern (SVHC), has the ultimate aim of phasing out SVHC of non-essential uses. In order to obtain an authorisation, companies must prove either that the risk to health and the environment is controlled or there are strong socio- economic arguments. After 5 years, it is important to draw some lessons from the efficiency of REACH, whilst at the same time reviewing the Risk Management part of the legislation. Given the authorisation costs, how can industry still be competitive throughout the entire supply chain? What will be the impact on SMEs? Is there a risk that authorization results in the allocation of critical parts of the value chain outside the EU, creating loss-loss situations for economics as well as environment & human health? There are more than 100,000 of them out there, chemicals we mean, some of which we eat, or breathe or absorb through our skin. They are a part of nature, yet some are hazardous. Over 40,000 of them may pose a minimal risk – hence the growing need for European Union chemicals legislation which aims to generate information about impacts and protection against potential harms. The EU has therefore adopted a number of legislative instruments aimed at the control of chemicals across a range of commercial sectors. The focus of this monograph, as the subtitle indicates, is on REACH – the EU Regulation on the Registration, Evaluation, Authorisation and Restriction of Chemicals, which came into force in 2007. Its regulator, ECHA is the European Chemicals Agency. REACH, says the author is a daunting piece of legislation ‘one of the longest legislative instruments in the history of the EU’ and ideally requires a familiarity with toxicology to fully understand it, which is why, as the author suggests, it has engendered little in the way of significant academic writing. This book therefore does much to fill that gap and deserves full marks for the clarity of its writing and explanation. Then there is the subject of hybridity which is explained in a number of ways, including the existence of public and private regulation. Primarily however, the book concerns itself with the yoking together of hard and soft norms as the result of a shift to ‘new governance’ which will be familiar to governance scholars at whom the book is partly aimed. There is little doubt that legal practitioners, (especially environmental lawyers), consultants, academics and policy makers will come to regard this book as an important and accessible explanation of REACH and also an useful starting point for further research on EU chemicals legislation. The publication date is cited as at 2015.

What Is the New REACH Guidance?

On June 28, 2017 the European Chemicals Agency released an update to their guidance on requirements for substances in articles. This guidance, for the REACH Regulation, clarifies communication requirements for substances of very high concern (SVHCs), in relation to the Court of Justice of the European Union's (CJEU) 'once an article always an article' ruling. The ruling was necessary in response to a number of EU Member States who did not agree with the interpretation. France was committed to enforcing REACH under their own interpretation of the 'once an article always an article' ruling. This resulted in two French trade associations requesting a ruling from the European Court of Justice. Prior to the updated guidance, companies have been adapting without official guidance from the European Chemicals Agency. The ruling states that SVHC compliance should be based on concentration thresholds for each individual article within a product or object, not the product as a whole. This was a game changer for industry. With this release, suppliers and importers now have the context they need to assess compliance with the requirements of Article 33 and Article 7(2) of the REACH Regulation. The improvements offer a more comprehensive set of examples to help them understand the conditions under which they must communicate the composition of their products. This is a strong signal that the ECHA will continue to provide further and ongoing industry guidance in relation to the REACH Regulation. With the adoption of the Better Regulation Agenda on 19th May, the European Commission is taking first concrete steps in the definition of its policy. This issue is expected to be heavily discussed in Parliament and Council in the following weeks, all the more since the Parliament has been very careful about the risk of better regulation being misused to remove environmental laws. There is a growing interest across stakeholders for the application of the better regulation approach to the management of chemicals. ECHA publishes a report on the use of alternatives to testing in animals for the REACH Regulation. Interview with Leena Ylä-Mononen, Director of Evaluation and Norbert Fedtke, Head of Unit of Evaluation about the findings of the report. REACH is clear that every effort must be made so that testing chemicals on animals is truly a last resort -- when there is no other scientifically reliable way of showing the impact on humans or the environment. REACH also demands that companies in possession of data on a chemical must share it (and share the cost) with any other companies making the same substance, thereby removing the potential for duplicate testing. What is REACH? The council of the European Union has in the year 2006 put in place the REACH Regulation N°1907/2006. The text concerning chemical substances and dangerous mixtures aims to provide a better protection of the human health and the environment. All this is also to promote the innovation and the competitiveness of the European Industry. The REACH regulation is in place since 1st of June 2007. Esterline Connection Technologies (SOURIAU-SUNBANK), being fully aware of the obligations implemented with this regulations has set up a surveillance process for the manufacturing process and the utilization of chemical substances. Following the publication of the regulation 348/2013/EU, the use of chemical substances based on chrome hexavalents (CrVI) will be banned from begin of the 21st of September 2017 without having an authorization. Obliging companies to register and provide information on the chemicals they use should enable public authorities to identify their properties more quickly and accurately. Particularly severe on toxic products, the new rules will encourage the European chemicals industry to develop new substances that are less harmful for people and the environment. As a result, the sector itself should also gain a lead in innovative and sustainable technologies.
