Can simple rules solve social coordination problems better than regulations do? Prof. Richard Epstein of NYU School of Law argues “yes,” giving examples of coordination through simple rules explaining drawbacks that top-down rules pose in different kinds of transactions. Professor Epstein, in this series on the Common Law, provides an alternative to the conventional view that property rights are arbitrarily created by the state, and therefore can be changed at will by the state. A few simple rules, he argues, are universal principles of social organization, consistent across time and culture, which form the basis of social gains. From the U.S. Department of Agriculture dictating how butchers cure meat to New York City's then-Mayor Michael Bloomberg banning food donations to homeless people to banning berry-picking in public parks, no food practice seems too small to regulate in the name of safety. A solution, says Linnekin in an interview with Reason's Nick Gillespie, is to simply emphasize good outcomes rather than rigid processes. Linnekin, who founded the nonprofit Keep Food Legal and has served as an expert witness in an ongoing federal First Amendment food-labeling lawsuit, also writes about "food freedom" at Reason.com every Saturday. Mystery food: US Senators fight Vermont GMO labeling law
Senators from both side of the aisle are trying to defeat Vermont’s new genetically modified organism labeling law, which recently went into effect. Professor James O’Reilly discusses his career path which began as an Associate General Counsel at Procter & Gamble for 24 years where he worked to ensure the company’s products were FDA compliant and worked with Congress to create drug and medical device legislation. His book, Food and Drug Administration, West (1979-date, 3 vol. 5th Ed. 2015) was cited by the U.S. Supreme Court as "The expert" on FDA law. He also taught several courses at the University of Cincinnati College of Law including administrative law, food and drug law, and systems of regulation. He now teaches at the University of Cincinnati College of Medicine courses relating to public health services and sciences. Edgar J. Asebey is an FDA attorney and partner at Keller Asebey Life Science Law. He has a background in molecular biology and early in his career worked as a patent and licensing specialist at the National Cancer Institute at NIH. Today he spends the majority of his time assisting clients with complex FDA compliance matters. He represents clients in all the life sciences (food, drug, cosmetics, and medical devices) – and has specialized in providing regulatory guidance to international client companies. North Korea’s hair-brained leader, Kim Jong-Un, brought in one of the strangest laws ever. He decreed that there are only 28 government approved hair styles that men and women can get. To be specific, there are 10 for men and 18 for women. Strangely though, the lardy leader’s own unique slicked back style isn’t on the list, which just seems unfair. Spiked hair is explicitly banned, presumably because it’s rebellious, or maybe hair wax is just rare in the despotic North.According to North Korean defectors, Kim Jong-Un likes to blur the lines between fiction and reality, implementing some strange Sci-Fi vetting process for the capital city. Basically, if you want to live in Pyongyang and don’t have express permission from the government, then you’re out of luck. The city is apparently reserved for the most successful, and more importantly loyal, people. Which isn’t surprising when you consider housing assignments are decided by the government. It’s kind of like The Capital in the Hunger Games but without the bloodsport… we hope.Somewhat shockingly, elections are held every five years in North Korea – it is the Democratic People’s Republic of Korea after all.
