Foreign exchange regulation is a form of financial regulation specifically aimed at the Forex market which is decentralized and operates with no central exchange or clearing house. Due to its decentralised and global nature, foreign exchange market has been more prone to foreign exchange fraud and has been less regulated than other financial markets. However some countries do regulate forex brokers through governmental and independent supervisory bodies, for example the National Futures Association and the Commodity Futures Trading Commission in the US, the Australian Securities and Investments Commission in Australia and the Financial Conduct Authority in the UK. These bodies act as watchdogs for their respective markets and provide financial licenses to organizations that comply with local regulations. The objective of regulation is to ensure fair and ethical business behaviour. In their turn all foreign exchange brokers, investment banks and signal sellers have to operate in compliance with the rules and standards laid down by the Forex regulators. Typically they must be registered and licensed in the country where their operations are based. Licensed brokers may be subject to recurrent audits, reviews and evaluations to check that they meet the industry standards. Foreign exchange brokers may have capital requirements which require them to hold a sufficient amount of funds to be able to execute and complete foreign exchange contracts concluded by their clients and also to return clients’ funds intact in case of bankruptcy. Each Forex regulator operates within its own jurisdiction and regulation and enforcement varies significantly from country to country. In the European Union a license from one member state covers the whole continent under the Mifid regulation and has resulted in regulatory arbitrage where companies select the EU country that imposes the least controls such as CySEC in Cyprus. Not all foreign exchange brokers are regulated and many will register in jurisdictions that impose low-regulatory environments such as tax havens and corporate havens that form part of offshore banking.

VO National Assembly (NA) members debates foreign currencies law INTRO: National Assembly (NA) members want the proposed Law on Foreign Currencies Management to limit the exchange and use of foreign currencies by the general public, as despite the controls in place currently the exchange of currencies continues unregulated. STORY: The NA members made the suggestion when debating the draft to the Law on Foreign Currencies Management which was taken to Monday’s agenda of the ongoing NA session. The newly drafted law aims to enhance the management of foreign currencies and maintain the stability of the Lao kip in relation with foreign currencies amidst regional and international integration. The draft law has nine parts containing eight chapters, which are divided into 53 articles. During the morning debate, NA members focused on Part No.2, which was about the activities related to foreign currencies, including the possession, use, and exchange of currencies in Laos, transference, and import-export of currencies in cash to and from the country. Article No.10 of the draft law says that individuals, legal entities, and organisations must use Lao kip in paying for goods, services, debts, salaries and duties to the government. The article also states that for contracted amounts, notices and advertising should be posted in the national currency except in such exceptional cases as permitted by the government. The NA members wanted more details on the integrated regulations which will operate in conjunction with the law and what measures will be taken to educate members of the public to protect and use only the national currency. The draft law also sets out the fines for offenders, which will vary depending on the size or seriousness of the case. For instance, a fine of one million kip shall be imposed on anyone found guilty of advertising prices in foreign currency, which shall be doubled in the instance of a repeat offence. In his response to the NA comments, Bank of Lao PDR Vice Governor Sonexay Sithphaxay spoke on behalf of the law drafting sub-committee. He said the sub-committee will further improve the draft according to the NA members’ suggestions, especially the penalties imposed on offences which threaten the stability of the national currency.

Accordingly, the Central Govt, has made • Foreign Exchange Management (Current Account Transactions) Rules, 2000.   Foreign Exchange Management (Current Account Transactions) Rules, 2000.   Rule 3: Prohibited Current Account Transactions: Drawal of foreign exchange by any person for the following purpose is prohibited, namely : (a) a transaction specified in the Schedule I; or (b) a travel to Nepal and/or Bhutan; or (c) a transaction with a person resident in Nepal or Bhutan (This may be exmpted by RBI)   Schedule I 1. Remittance out of lottery winnings 2. Remittance of income from racing/riding, etc., or any other hobby 3. Remittance for purchase of lottery tickets, banned/prescribed magazines, football pools, sweepstakes etc. 4. Payment of commission on exports made towards equity investment in Joint Ventures/Wholly Owned Subsidiaries abroad of Indian companies. 5. Remittance of dividend by any company to which the requirement of dividend balancing is applicable 6. Payment of commission on exports under Rupee State Credit Route, (except commission up to 10% of invoice value of exports of tea and tobacco.] 7.
