The Exchange Stabilization Fund (ESF) is an emergency reserve fund of the United States Treasury Department, normally used for foreign exchange intervention. This arrangement (as opposed to having the central bank intervene directly) allows the US government to influence currency exchange rates without affecting domestic money supply.
As of October 2009, the fund held assets worth $105 billion, including $58.1 billion in special drawing rights (SDR) from the International Monetary Fund.
The U.S. Exchange Stabilization Fund was established at the Treasury Department by a provision in the Gold Reserve Act of January 31, 1934. 31 U.S.C. § 5117. It was intended as a response to Britain's Exchange Equalisation Account. The fund began operations in April 1934, financed by $2 billion of the $2.8 billion paper profit the government realized from raising the price of gold to $35 an ounce from $20.67. The act authorized the ESF to use its capital to deal in gold and foreign exchange to stabilize the exchange value of the dollar. The ESF as originally designed was part of the executive branch not subject to legislative oversight.
The Gold Reserve Act authorized the ESF to use such assets as were not needed for exchange market stabilization to deal in government securities. The Fund had no statutory authority, however, to engage in other activities that it began to undertake. The principal such extraneous activity it devoted itself to was lending dollars to politically favored governments.
In 1938–40, the director of the Division of Monetary Research, Harry Dexter White, worked on a proposal for loans to Latin America and participated in plans for an Inter-American Bank, which did not materialize. The plan for an Inter-American Bank, however, inspired White's first draft of the subsequent plans for the International Monetary Fund and the World Bank that White prepared in 1941 at Secretary of the U.S. Treasury Henry Morgenthau's direction.
It was funded by Franklin D. Roosevelt under the Emergency Banking Act of 1933, with Archie Lochhead serving as its first Director.
The Special Drawing Rights Act of 1968, 22 U.S.C. § 286o, likewise provided that any special drawing rights (SDRs) allocated by the International Monetary Fund or otherwise acquired by the United States are resources of the ESF. In accordance with the Act, SDRs can be "monetized" (i.e., converted into dollars) by having the Secretary of the Treasury issue Special Drawing Rights Certificates (SDRCs) to the Federal Reserve System. The amount of SDRCs are limited to the dollar value of the ESF's SDR holdings. The dollar proceeds of such monetizations are assets of the ESF, and the SDRCs are a counterpart liability of the ESF. Treasury has a written understanding with the Fed that the SDRCs will be redeemed when ESF dollar holdings appear to be in excess of foreseeable requirements. Treasury does not pay interest on SDRCs.
A change in the law, in 1970, allows the Secretary of the Treasury, with the approval of the President, to use money in the ESF to "deal in gold, foreign exchange, and other instruments of credit and securities."
The U.S. government used the fund to provide $20 billion in currency swaps and loan guarantees to Mexico following the 1994 economic crisis in Mexico. This was somewhat controversial at the time, because President Clinton had tried and failed to pass the Mexican Stabilization Act through Congress. Use of the ESF circumvented the need for approval of the legislative branch. In response, Congress passed and President Clinton signed the Mexican Debt Disclosure Act of 1995, which implicitly accepted the use of the ESF, but required reports to Congress every six months on the status of the loans. At the end of the crisis, the U.S. made a $500 million profit on the loans.
On September 19, 2008, U.S. Treasury Department announced that up to $50 billion in the ESF would temporarily be made available to guarantee deposits in certain money market funds.

1. Notes with white borders.

Today is Friday 8th February 2019 and we are discussing an article published in this week’s edition of Financial Adviser written by Saloni Sardana a feature writer for the publication and its entitled “Cryptocurrency lessons of 2018”.
This article briefly covers the performance of cryptocurrencies particularly in 2018 and also provides the views of the UK Regulator and a number of financial advisers and their approach to this new investment phenomenon.
It points out that in 2018 Bitcoin closed at $3,769 or £2,920 very far removed from its $20,000 high in December 2017 and no-where near the speculation at the time which would see bitcoin rise to at least $50,000 in 2018 and some even forecast $100,000. Mmmm does this remind you of similar cases – ah yes gold at $10,000 an oz and silver at $600 as we recall one or two people predict.
In the Premium Section of the Inner Sanctum we actually read the article in full and discuss its implications as its quite a lengthy one.
In a nutshell, the article paves the way for blockchain investment products to fall within the legal financial framework and will formally enable advisers to include it in an investment portfolio.
Our take on this, or at least our current take on this is, that cryptocurrencies should not be seen as an investment but as a speculative medium of exchange – in other words a currency – where its value can rise and fall but with perhaps larger than normal gyrations. In the past whenever we made financial recommendations there was always an element of cash holdings included, and to the more enlightened amongst us a small level of gold holdings recommended (though the latter was rarely taken up).
How the Regulators deal with this is anyone’s guess, but deal with it they shall, but what hasn’t gone unnoticed to us is that, any general acceptance of crypto’s within an overall investment portfolio is likely to crowd out, to some extent, any provision made for gold and silver.
So, whilst we can see the speculative attraction of bitcoin and other cryptos we can also envisage a slight deviation from gold and silver investments to compensate. This should not be the case, as gold and silver should merely be portrayed as a ‘currency hedge’ and used as such – but in investors minds and sometimes advisers minds, they will want to stick to the tried and tested formula of equities, treasuries, bonds, property and cash.
Formal regulated acceptance may indeed not be that far away as HM Revenue and Customs have already classed bitcoin and cryptocurrency gains to fall within Capital gains tax entitlements.
HMRC has summarised the following scenarios as ones in which it expects a cryptocurrency tax liability could be triggered:
1. Selling crypto assets for money
2. Exchanging crypto assets for a different type of crypto asset
3. Using crypto assets to pay for goods or services
4. Giving away crypto assets.
From this we can clearly see that paths are being created to allow for the formal recognition, regulation and taxation of crypto assets and eventually currencies – the question is though will the current players suffice or will the Regulators insist on a State or Country created cryptocurrency and here’s one for the future, a Global World cryptocurrency.

Procedure for Adjudication (Section 16) 00:00:34 - 00:13:18
Adjudicating Authority (AA) - Purpose of Appointment and Duties
-AA shall be appointed by the the Central Government by issuing a notification in the Official Gazette.
-AA is appointed to adjudicate and impose penalties.
-AA shall endeavor to dispose of the complaint within 1 year.
-AA shall give a reasonable opportunity of being heard of the accused person.
Cognizance of Offenses (Section 16)
-AA shall not take cognizance of any contravention under FEMA except upon a complaint in writing made by any officer authorized by the central government.
Issue of show cause notice
-Purpose is to give an opportunity to the accused to show cause as to why an inquiry should not be held against him. He is allowed a time of 10 days.
Procedure for Holding Inquiry - Illustration
-AA shall consider the reply made by the accused person.
-AA shall fix a date for the hearing, if it is of the opinion that an inquiry should be held.
-Hearing shall be held.
Following provisions shall apply to the hearing.
-Appear in person or assistance by legal practitioner
-Explanation of alleged contravention
-Opportunity to produce the documents or evidence
-Hearing may be adjourned from time to time
-AA may summon and enforce attendance
-AA may also proceed ex parte
Order levying Penalty
-If AA is satisfied that contravention of act has been committed, it shall impose penalty and specify the nature of contravention committed and the reason for the decision.
Imprisonment for non payment of penalty (Section 14)
-The penalty must be paid within 90 days
-If default is made in payment of penalty, the accused shall be liable to civil imprisonment
-The term for imprisonment shall be up to 3 years, if penalty exceeds Rs. 1 crore and up to 6 months, in any other case.
-The defaulter shall be released if the penalty is paid after imprisonment
Appeal to SD (Appeals) (Section 17)
Appeal to SD (Appeals) may be made against the order of AA, if AA is Assistant Director of Enforcement or Deputy Director of Enforcement
-The appeal shall be filed within 45 days
Appeal to AT (Section 19)

What Is a Bill of Exchange?
Have you ever written a check for rent or groceries? Then you've used something very similar to a bill of exchange. A bill of exchange is a legally binding, written document that orders a certain party to pay a specific amount of money to a second party. Some bills of exchange may say that the money is due on a predetermined future date, or they may state that payment is due on demand.
It's used in the transaction of goods and services. The bill of exchange is signed by the party that owes money (the payer) and given to the party entitled to the money (the seller or payee), who can then use it to fulfill a contract for payment. However, the seller may also endorse the bill of exchange and transfer it to someone else, thereby passing the payment on to another party.
Note that when a bill of exchange is issued by a financial institution, it's often called a bank draft. When it's issued by an individual during a transaction, it's referred to as a trade draft.

Before money: Trade through barter
Problem: double coincidence of wants
- A doctor cannot produce own food - must find a farmer
- farmer must have the food the doctor wants and require healthcare
Must negotiate rate at which medical care / food are exchanged.
He must do this for all other wants e.g. plumbing services, clothes, etc.
Saving for the future could get difficult - some goods are perishable and hard to store (e.g. strawberries)
People would be more generalised in their skills and self-sufficient i.e. you grew your own crops, kept your own livestock, built your own home.
Using money: Invention of money allowed the benefits of specialisation without difficulty of barter.
- Doctor will accept money in return for providing healthcare to the farmer
- Others will also accept money for provision of other goods/services
- Farmer will accept money in return for providing food
Functions of money:
- Unit of Account - Identify the value of goods and services (e.g. a car worth £10,000 opposed to 20,000 tons of tuna).
- Store of value
a) Hold onto the money and spend it in the future (i.e. savings)
b) Not an option for perishable goods (e.g. strawberries rot
over time)
- Medium of exchange - Universal acceptability as payment for goods and services
Other desirable qualities of money are that it should be:
Easy to carry around or portable - Lead bars could be money but they are not easy to carry.
Durable - Unlike strawberries it should not perish over time.
In scarce supply - This will ensure its value remains stable over time.
Divisible - Easily divided into different values so that transactions of varying amounts can be settled (cannot divide a cow into smaller units).
Fungible - Something that is Interchangeable, returnable, or easily replaced.

There is no reason to pay taxes on investment property like rentals, raw land, ranches, multi-family or any other non-residential property. The IRC 1031 provisions allow you to eliminate Federal and State Capital gains, the 3.8% Medicare tax and eliminate depreciation recapture.

The 1031 exchange is a legal provision set forth by the US Supreme Court in 1979 that allows you to defer federal and state capital gain taxes and eliminate depreciation recapture on rental properties.
Federal capital gains can cost you 15% to 20% when you sell, State capital gains in Montana are 6.9% and Montana has the 12th highest combined capital gains tax rate in the U.S. at 31.9%. Plus, if you own rental property and sell without a 1031 exchange you will have to pay back 20% of the value of all the depreciation.
There are a host of rules each exchanger must follow in order to have an exchange that complies with the IRS regulations. First, the property must be held for investment purposes and there are strict limitations on personal use. Second, a qualified escrow must be used to hold funds during the exchange so that the exchanger does not have constructive receipt of their proceeds. Third, there are 45 days to identify replacement property following the sale of the property you are relinquishing and there are 180 total days to complete the exchange to stay inside the IRS safe harbors.
The like-kind provisions of the IRS code have confused more real estate investors and Realtors than any other single rule in history. It DOES NOT mean that you have to buy the same type of property, it only means that if you are selling real estate then you must buy real estate. So, you can go from raw land to multi-family rental property or you could go from a ranch to a commercial shopping mall. All of these are legitimate uses according to the like-kind provisions.
How the property you are selling is legally held in title must be identical when you acquire a new property. So, if a property is held in joint tenancy when it is sold the replacement property must be acquired in the same joint tenancy. This provision holds some real pitfalls for limited liability companies, which are defined by the IRS as partnerships. In order for an exchange to work for partnerships all member must remain the same when a new property is acquired.
