Smart contracts help you exchange money, property, shares, or anything of value in a transparent, conflict-free way, while avoiding the services of a middleman. The best way to describe smart contracts is to compare the technology to a vending machine. Ordinarily, you would go to a lawyer or a notary, pay them, and wait while you get the document. With smart contracts, you simply drop a bitcoin into the vending machine (i.e. ledger), and your escrow, driver’s license, or whatever drops into your account. More so, smart contracts not only define the rules and penalties around an agreement in the same way that a traditional contract does, but also automatically enforce those obligations. Example Suppose you rent an apartment from me. You can do this through the blockchain by paying in cryptocurrency. You get a receipt which is held in our virtual contract; I give you the digital entry key which comes to you by a specified date. If the key doesn’t come on time, the blockchain releases a refund. If I send the key before the rental date, the function holds it releasing both the fee and key to you and me respectively when the date arrives. The system works on the If-Then premise and is witnessed by hundreds of people, so you can expect a faultless delivery. If I give you the key, I’m sure to be paid. If you send a certain amount in bitcoins, you receive the key. The document is automatically cancelled after the time, and the code cannot be interfered by either of us without the other knowing, since all participants are simultaneously alerted. You can use smart contracts for all sort of situations that range from financial derivatives to insurance premiums, breach contracts, property law, credit enforcement, financial services, legal processes and crowd funding agreements. Then I show how ethereum introduces a second type of account: a code controlled account (aka smart contract). This type of account does not have a private key but instead is controlled by code. It can store ether, just like user accounts, or it can keep a balance of 0 and be used to deliver some other function within the context of an application. He explains that smart contracts don't solve the problems of incomplete contracts that his work is focused on. Can you tell me at all about what you think about smart contracts that we're seeing now? Are they gonna revolutionize everything? Do they solve all the problems that you were working on? Oliver Hart: That's right, they're gonna take the prize away. It's all gonna be irrelevant. I must admit — first, that I know little about smart contracts. I'm trying to understand more about them as I am about bitcoin, blockchain, all the rest. It's all a bit mysterious. I'm doubtful that it's going to be a cure-all. I mean, it seems that for some things it could be quite useful 'cause it can automate certain things. And so, you know, if I have some sort of insurance contract which says that if a certain event happens then I'm gonna get paid something, then we can sort of make that automatic so it just comes right into my account. I don't have to check on anything or call up the insurance company. So, things like that can certainly help but they're not going to solve — unfortunately the problems I've been particularly concerned with are contracts that are written for the long-term and where people are in long-term relationships and economic relationships and they're trying to anticipate what might happen in the future which is very difficult to do, and write a contract which takes into account these eventualities. They can't do it because the future's very uncertain, many things can happen that we don't really expect, or are able to predict. I don't see how smart contracts are gonna solve that problem. Or to be more concrete, I mean, if we have a long-term economic relationship I think it's important that we're on the same page, we understand each other, if something unexpected comes up we have some reasonable way of dealing with it that makes us both comfortable, happy. I don't — that's much more about communication between us I think, at the time we write the contract than it is about any sort of automated device. Silverstein: And last question can you give an example of the types of incomplete contracts and the bad incentives that those create? Hart: I use the example of a power plant that locates next to a coal mine and wants to use the coal to burn to make electricity. And this is a real example — I mean there's empirical work on things like this and the thing is once you've located next to the mine, you really want that relationship to work out, because it's very costly to now ship the coal in from somewhere else. But many things can happen during the course of this relationship so just deciding ahead of time, you know, exactly what kind of coal, how much, how much I should pay you, and all that. Very difficult given that the world's going to be changing. New sources of energy, solar power gonna come along and that's gonna affect the industry but we probably can't anticipate that and write that into the contract. And so later on we may get into some argument about: "I want a different kind of coal," and the question is how much should I pay for it and this can be costly, this kind of argument and distort incentives and, you know ... I don't think a smart — you know — I'd love to see a computer solve that problem, but I think we're some way away from that.

Smart Contract - What is a smart contract in Blockchain? You must be hearing a lot about smart contracts and must be asking these questions now a days. What are smart contracts? What could be the applications of smart contracts? How it would revolutionise and replace the way we are entering in to contracts now? What is the difference between Bitcoin and Ethereum Blockchain? In simple terms, smart contracts are “programs that are stored in Ethereum Blockchain”. Programs that are created to satisfy certain conditions like “True or false”, “If or Else” etc. in Ethereum Blockchain are called smart contracts. If a given condition is satisfied a course of action takes place or another event takes place if the condition is not satisfied. How can it change the existing system? Revolutionary transformations could take place in future with the help of smart contracts. An example would be, say you bought a new car. The ownership of the car has to be registered with the RTO. The RT Officer registers the ownership of the car and gives you the Registered Number. Currently this process is done manually which is a time consuming process. With the help of smart contracts the registration can be done online. The details are stored in the database of vehicles which can be accessed by individual owners. Proof of work, consistency algorithm etc. are used for validating and storing the data. Smart contracts ensure that the database is up-to-date and secure. Also, it prevents unauthorized access to the database. Hence the details would be safe and secure. Any sort of malpractices would be impossible. Applications of Smart contracts Smart Contracts can be utilized for storing centralized database of high net worth properties like purchase of a house, vehicles, jewellery etc. The negative side of Smart Contract is that it cannot be utilized for transactions involving small payments. For example, when you consume tea from a tea shop. The payment cannot be made with the help of Blockchain technology as it is not an economically viable option. Because, the consumer will have to bear the memory processing charges or operational charges for the use of smart contracts. The charge would be higher than the actual value of the item or net worth of the item. In this example the charge could be higher than that of the tea that you have consumed. In Ethereum Blockchain, the charges are broken into smallest unit known as, “Gas”. Smart Contracts, thus, can be utilized for processing and storage of assets that have high net worth and storing secure data like audit related information. Also, Private Blockchain and cryptocurrencies can be created for storage of data and processing transactions. An example of private Blockchain is that if you have started a YouTube Channel and you want to attract subscribers to the channel. You could program a smart contract which could enable the subscribers the right to receive Ethereum for each subscription. Thus, when a person subscribes your channel, the smart contract gets triggered and transfers certain units of Ethereum to his wallet. Difference between Ethereum and Bitcoin? Ethereum is platform for creation of smart contracts and at the same time it can be utilized as a Cryptocurrency. Bitcoin can also be utilized for storing smart contracts but the contracts will not be “Smart”. Bitcoin is used for storing transactions and not contracts.

En la siguiente entrevista, Alex Preuskchat pregunta a Carlos sobre todas las posibilidades que encierra este concepto tan transversal. El concepto de Smart contract es aparentemente sencillo, si nos guiamos por la definición básica de contrato que todos tenemos en mente, un compromiso entre distintas partes que obliga a los contrayentes y cuyo incumplimiento es exigible. Sin embargo, un Smart contract incorpora tres diferencias importantes, la primera es que “se auto ejecuta”, es decir no necesitas de la intervención de un tercer ente “para validar si las condiciones se han cumplido o no”, porque el contrato es suficientemente inteligente para ejecutar esta función “y decidir si se han cumplido las condiciones y clausulas” y por tanto “cómo proceder”. La segunda es donde reside el documento, que ya no tiene un formato de papel al uso, sino que “existe digitalmente en la cadena de bloques” y por último, que no requiere de un tercero, “de un humano” para realizar estas validaciones. Pero esta primera definición es muy superficial y sirve para definir los proyectos van surgiendo en la actualidad pero “en el futuro irá mucho más allá y la palabra contrato no será la más adecuada” por las propias limitaciones que tiene y que son ampliamente superadas por el concepto y las posibilidades de un Smart contract, así que podría ser más ajustado hablar en el futuro de “más bien como una especie de agente virtual e inteligente que va a regular muchas cosas, desde las relaciones de los directivos de una empresa hasta nuestras relaciones con los proveedores del servicio de telefonía…” Para Vivas, “la ventaja de una tecnología descentralizada es que permite desarrollos muy interesantes y muy

Her career has focused on various aspects of licensing and rights. Edward Klaris is the Managing Partner of Klaris Law PLLC, a media and intellectual property law firm, and he is C.E.O. of KlarisIP LLC, a consulting and managed services firm specializing in intellectual property rights & royalty management, digital asset management and master data management. Ed has been an adjunct professor of law at Columbia Law School since 2005 where he teaches media and intellectual property law. He is Senior Advisor to Desilva & Phillips, a premiere media investment bank. Ed serves on the Communications Committee of Human Rights Watch and is a member of the Communications Law Committee of the New York City Bar Association. For more than eight years, Ed was Senior Vice President of Intellectual Property Assets & Rights at Condé Nast, where he led a group of about 50 people managing and monetizing all of the company’s media assets worldwide. Ed was General Counsel of The New Yorker for more than six years; he was Media Counsel at ABC, Inc.; and he started his career defending media and entertainment companies against libel, privacy, newsgathering, copyright, and other claims in courts around the country. Ed was the Chair of the Communications Law Committee of the NY State Bar, and was Chairman of the Board of Pilobolus Dance Theater for thirteen years.

Hawk: The Blockchain Model of Cryptography and Privacy-Preserving Smart Contracts Andrew Miller (University of Maryland) Presented at the 2016 IEEE Symposium on Security & Privacy May 23–25, 2016 San Jose, CA http://www.ieee-security.org/TC/SP2016/ ABSTRACT Emerging smart contract systems over decentralized cryptocurrencies allow mutually distrustful parties to transact safely without trusted third parties. In the event of contractual breaches or aborts, the decentralized blockchain ensures that honest parties obtain commensurate compensation. Existing systems, however, lack transactional privacy. All transactions, including flow of money between pseudonyms and amount transacted, are exposed on the blockchain. We present Hawk, a decentralized smart contract system that does not store financial transactions in the clear on the blockchain, thus retaining transactional privacy from the public's view. A Hawk programmer can write a private smart contract in an intuitive manner without having to implement cryptography, and our compiler automatically generates an efficient cryptographic protocol where contractual parties interact with the blockchain, using cryptographic primitives such as zero-knowledge proofs. To formally define and reason about the security of our protocols, we are the first to formalize the blockchain model of cryptography. The formal modeling is of independent interest. We advocate the community to adopt such a formal model when designing applications atop decentralized blockchains.
