Article 13 and EU Copyright Law explained: This is how Europe will destroy the Internet

The new EU copyright law is going to have drastic affects on the freedom and openness of the Internet. Beyond banning memes, Article 13 of the European Copyright Directive 2018 will result in automated surveillance and centralized control of the Internet. The directive makes online platforms liable for the content generated by their users. That means that on top of punitive and vaguely worded terms of services, Internet gate-keepers like Facebook, Google, or Twitter will be required by law to proactively monitor and censor content. These online platforms will be required by law to create automated mechanisms to filter infringing content. Such technology would essentially turn into “upload filters”. These automated filters won’t be recognizing between infringing and legitimate content, like parodies, satire, commentary or other instances of fair use. To balance the flaws of automated upload filters, the directive also requires platforms to build staffed systems for filing complaints for illegitimate takedowns. EU Law - Direct Effect

Direct effect allows rights under EU law to be enforced within a domestic court system. Vertical direct effect allows rights to be enforced against an emanation of the state while horizontal direct effect allows rights to be enforced against other individuals or against companies. Direct effect is also conditional on the type of EU law that is being enforced. Treaties are a form of primary legislation and have vertical and horizontal direct effect so long as the relevant treaty article matches the conditions set out in Van Gend en Loos (1963): Clear and unconditional Prohibition Not dependent on member state implementation Regulations are directly applicable and as such also have vertical and horizontal direct effect. Directives, in principle, only have vertical direct effect because they are an obligation for member states to implement them. Even then they can only be enforced when they grant rights to individuals (Defrenne v SABENA (No. 2) (1979)) and the time limit for implementation has passed (Pubblico Ministero v Ratti (1979)). However there is a way that directives can have horizontal direct effect and this is known as indirect effect. This works because the courts themselves can be considered as emanations of the state and so in their judgments have to enforce EU law between individuals. This concept first arose in Von Colson v Land Nordrhein-Westfalen (1984) and was applied in the UK through Lister v Forth Dry Dock [1989]. An emanation of the state was defined in Foster v British Gas plc [1990] as a body that: Provides a public service Under the control of the state Has special powers beyond those of individuals

EU Law - The Single Market

The single market is a at the heart of the Brexit debate as access to the market also depends on the free movement of labour. The single market is often taken for granted but required a lot of hard work starting mainly with the Single European Act 1986 that now forms a part of the Treaty on the Functioning of the European Union. Article 26(1) removes the deadline for the single market as this is an ongoing task while 26(2) defines the single market as "an area without internal frontiers in which the free movement of goods, persons, services and capital is ensured". To achieve these aims 26(3) describes the Council taking action based on the recommendations and advice of the Commission. Article 27 states that when doing this the Commission will take into account the effort required on the part of national economies and can allow for derogations in certain circumstances. The main power for making legislation comes from Article 114 as Article 115 requires unanimity and only allows for the passing of directives. On the other hand Article 114 makes use of the ordinary legislative procedure and allows for regulations as well as directives. This power is not unlimited as seen in Tobacco Advertising [2000] where the ECJ held that the objective has to be the harmonisation of the internal market but even in Tobacco Advertising [2006] a small change to the original directive showed the broad approach the ECJ would be prepared to take. There are also, however, qualifications within article 114. Article 114(2) state that the procedure cannot apply to fiscal provisions, free movement of people and employment rights. (3) meanwhile states that for health, safety, environmental and consumer protection the base line is a high level of protection based on the latest scientific research. However the most controversial qualification comes from Arts. 114(4)-(9) which potentially allows member states themselves to go against a harmonising measure. This is rarely used though and can only be applied in restricted circumstances. For (4) the concern must relate to environment, working environment or exceptions from art. 36 and only provides for the retention of existing legislation in that state. (5) does allow for new legislation to be passed but must be specific to that MS and based on new scientific evidence. Thus we can see this is not only restrictive within the Article but the checks from the Commission and the judgments of the ECJ will always be towards enforcing the treaty while the burden of proof itself is on the state. Finally Art. 114(10) allows member states to take temporary measures where there is a concern relating to Art.36. In practical terms the EU uses this legislation to develop the single market through various approaches such as mutual recognition and setting standards in certain industries. The single market is an on going process and while it is scrutinised from a political and social standpoint it continues to harmonise things across all member states.

STRASBOURG — Last week the European Union got one step closer to neutering the Internet. Article 13 is designed to prevent copyright infringement via automated systems and filters. Critics say it's censorship by other means and that it'll end free speech as we know it. It's being pushed by German EU lawmaker Axel Voss. The man's official Twitter account has featured some parody in the past. A series of tweets labelled, "Turn of the eras in the digital age," from May 2015 show three satirical images lamenting the Internet. In July, BuzzFeed Germany discovered a slew of copyrighted images on his Facebook and Twitter pages. Apparently, the Facebook images were deleted after the website reached out to him for comment. According to a Google translation of the article, Voss or his staff didn't really tell the site if he had the right to use them. Europe’s strongest nation joins a major military initiative, increases weapons sales to Middle East. wenty-three European Union nations took a major step toward forming a European army on Monday. They agreed to begin planning their defense, spending their money, and selecting their priorities like one large power rather than 23 smaller ones. Not everyone in the EU signed up for this. For some, handing over this much control of their defense was too much. Unlike many other EU treaties, this one has (some) teeth. Nations that don’t pull their weight can be kicked out of this new exclusive club. The agreement requires signatories to regularly increase their defense spending. The Nation wrote that the agreement is “calling for a massive increase in military investment and to pave the way for the deployment of European forces.” The signing ceremony was an “emotional moment” and a “historic moment in European defense,” said EU Foreign Policy and Defense Chief Federica Mogherini. German Foreign Minister Sigmar Gabriel called it “a milestone in European development.” This is a major step in these nations working more closely together. So now, when Germany is deciding what to spend its money on, it will do it with the entire EU in mind. These nations will work together on developing weapons, so instead of 23 nations developing 23 tanks, there will be much more pressure to develop a single EU tank. The deal contains quite a few practical steps that will help Europe work together, and you can read more about those in my article “EU Leaders Take ‘Historic’ Step Toward United Military.” This is something that the world should be more concerned about. Articles discussing a united European military are about the possibility of a new military superpower. It is extremely naive to assume such a power would never disagree with the United States. This is also heavily discussed in Bible prophecy. Many prophecies throughout the Bible discuss a united European superpower. It is a really important prophecy to watch for. To learn why and the good news beyond this, read “Why the Trumpet Watches Europe’s Push Toward a Unified Military.” Now another piece of news, more specifically from Germany, this week: German exports to Saudi Arabia and Egypt have quintupled—increased fivefold—in the third quarter of 2017 compared to the same time period last year. The German Economy Ministry disclosed the figures this week after requests from the Left Party. Egypt bought €300 million (us$342.8 million) of weapons in those two months alone, and Saudi Arabia spent €150 million ($171.4 million). The government hasn’t said what it sold to Egypt, but Saudi Arabia likely purchased four patrol boats and 110 military trucks. The Trumpet has long forecast that Germany would increase its involvement in the Middle East, and these kinds of arms sales are a big part of building its alliances and influence there. MEPs have rejected a committee proposal to begin negotiations to update copyright laws for the digital age. Parliament’s plenary voted by 318 votes to 278, with 31 abstentions to reject the negotiating mandate, proposed by the Legal Affairs Committee on 20 June. EU Law - Freedom of Establishment and Services

The distinction between establishment and services is based on the idea that establishment is more permanent whereas services are more temporary in nature. Establishment mainly falls under Art. 49 with 49(1) allowing for primary and secondary establishment and (2) prohibiting unequal or discriminatory treatment. The law in this area is directly effective as per Reyners [1974]. Equivalent qualifications across member states are interpreted broadly as per Heylens [1987] and also Directive 2005/36 Meanwhile article 49(2) has been broadened beyond discrimination to include any unjustified restriction on the freedom of establishment. The main case in this are is Gebhard [1995] that allows for restrictions only if they meet four criteria: 1) Non-discriminatory 2) Justified 3) Needed to secure an objective 4) Don't go beyond what is necessary to achieve that objective A national can rely on Art. 49 with respect to their own member state only when they have exercised the freedom of movement themselves as per Knoors [1979] Article 54 states companies should be treated in the same way as individuals and although company law can vary from state to state the ECJ has placed a lot of focus on achieving the overall objective of freedom of establishment as seen in Centros [1999] and Überseering [2002]. However once a company is established in a Member State they are then subject to that country's rules as regards incorporation etc. as per Daily Mail [1988] and Cartesio [2008] The liberalisation provided by Art. 54 means that it can be difficult to crack down on tax avoidance as seen in Cadbury Schweppes [2006]. Freedom of services is based on the temporary nature of the work rather than the infrastructure or, as per Commission v Portugal [2010], the period of time. Art. 57 loosely defines services and 58 excludes other services that are covered in other parts of the treaty. Art. 56 also has direct effect as per Van Binsbergen [1974]. Similarly there also has to be an inter-state element as seen in Deliège [2000] Also covered is the freedom to receive services; Luisi & Carbone [1984] The service does have to be provided for remuneration and this line can become blurred in relation to certain healthcare systems that are a hybrid between user and government payments Some controversial services such as abortion, gambling and marijuana can still be considered services (Grogan [1991]) but can be subject to national rules that provide a proportional and non-discriminatory restriction (Zenatti [1999]). Taking a broad definition it is even possible that certain social benefits may also fall within the definition; Cowan [1989]. Art. 62 allows for restrictions on policy, security and health grounds. Beyond this Van Binsbergen [1974] sets out the conditions for any restriction imposed by a Member State: 1) Pursuit of a legitimate public interest 2) Applied without discrimination 3) Proportionate 4) Respects fundamental rights (Carpenter [2002]) This freedom can be controversial as it allows greater liberalisation in the labour market at the expense of employee rights. This came to a head in Laval [2007] although this judgment has been tempered somewhat by the Rome I Regulation. Restrictions on tax grounds can be allowed to prevent fraud but not for other, broader reasons; Danner [2002]. Non-discriminatory restrictions can also be caught if they are a hinderance to the freedom of services (Alpine Investments [1995]) and Gebhard [1995] also applies within this context. The Bolkenstein Directive sought to achieve greater harmonisation by focusing on the country of origin but after protest this was watered down and so only mainly deals with a range of procedural and administrative issues.

EU Judicial Review - Arts 263 and 265 TFEU

An examination of judicial review and the relevant procedure under EU law and in particular articles 263, 264 and 265. Firstly there has to be a binding piece of secondary legislation such as a regulation, directive or decision and not a recommendation or opinion as these are not binding. A review has to be brought within two months of publication in the Official Journal or two months from when the applicant first new about the act. There are four grounds of review: Lack of competence (Germany v EP & Council [2000] (Tobacco advertising case)) Infringement of an essential procedural requirement (Roquette Frères v Council [1980]) Infringement of the Treaty or any rule of law relating to its application (Hautala v Council [2001]) Misuse of power (UK v Council (Re. Working Time Directive) [1996]) Locus standi for privileged applicants such as the European Council, European Commission, European Parliament and Member States is automatic. Semi-privileged applicants such as the European Central Bank, the Court of Auditors and the Committee of Regions can also challenge legislation when it affects their prerogaative. Challenging legislation through judicial review is much harder for non-privileged applicants as they can only challenge three types of act: An act addressed to that person An act of direct and individual concern A regulatory act of direct concern with no implementing measures The interpretation of direct and individual concern by the Court of Justice has been very problematic. A person is only directly concerned when they are directly affected by a piece of legislation such as in Société Louis Dreyfus et Cie v. Commission [1998]. There can be no intervening discretion exercised by a Member State as was the case in Eridana v Commission [1969]. Individual concern is the most controversial area of judicial review since the case of Plaumann v Commission [1963] and the establishment of the Plaumann test. The idea of a fixed, closed class has been interpreted so narrowly as to be almost meaningless. In fact it almost only ever applies retrospectively as in the case of Alfred Toepfer v Commission [1965]. There have been attempts to ameliorate the effects of Plaumann such as the abstract terminology test of Calpak [1980] but this had little practical effect despite claiming to look behind the form to the substance of a piece of legislation. Codorniu [1994] took Calpak to its logical conclusion but unfortunately has never been followed. Attorney-General Jacobs in Unión de Pequeños Agricultores (UPA) v Council [2002] suggested an alternative test based on whether the legislation had a substantial, adverse impact on the applicant but this was rejected in that case itself as well as in Jégo-Quéré [2004]. The actual meaning of the final type of act (A regulatory act of direct concern with no implementing measures) is still unclear since the Lisbon treaty but both Inuit v EP & Council [2013] and T&L Sugars v Commission [2015] shed some light and suggest the insertion does not break new ground beyond Plaumann. Article 264 empowers the court to annul a piece of legislation if a successful challenge is brought by an applicant. Article 265 is the converse to article 263 and allows a challenge for failure to act. However there has to be a duty to act (European Parliament v Commission [1985]) but the legislation must have been addressed to that person (Lord Bethel v Commission [1982]). Even if the applicant is successful the institution can respond by simply defining its position. An alternative for non-privileged applicants is to use art 267 (the preliminary reference procedure) but this has its own risks. An applicant has to break the law to bring the challenge and it is not certain that a court will make a reference to the CJEU.

EU approves legislation that could  'destroy the internet' (Article 11/13)

The European Union has taken the first step in passing new copyright legislation that critics say will tear the internet apart. This morning, the EU’s Legal Affairs Committee (JURI) voted in favor of the legislation, called the Copyright Directive. Although most of the directive simply updates technical language for copyright law in the age of the internet, it includes two highly controversial provisions. These are Article 11, a “link tax,” which would force online platforms like Facebook and Google to buy licenses from media companies before linking to their stories; and Article 13, an “upload filter,” which would require that everything uploaded online in the EU is checked for copyright infringement. (Think of it like YouTube’s Content ID system but for the whole internet.) EU lawmakers critical of the legislation say these Articles may have been proposed with good intentions — like protecting copyright owners — but are vaguely worded and ripe for abuse. “The methods to address the issue are catastrophic and will hurt the people they want to protect,” Green MEP Julia Reda told journalists earlier this week. Both Article 11 and Article 13 were approved by the JURI committee this morning but won’t become official legislation until passed by the entire European Parliament in a plenary vote. There’s no definite timetable for when such a vote might take place, but it would likely happen sometime between December of this year and the first half of 2019.
